General Terms and Conditions of the Service- und Tourismusmarketing Agentur TK GmbH

1. Area of application

For all orders via our online store the following terms and conditions apply. Our online store is aimed exclusively at consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity. Entrepreneur is a natural or legal person or a partnership with legal capacity, which acts in exercise of its commercial or independent professional activity when concluding a legal transaction.

2. Contract partner, conclusion of contract, correction possibilities

The sales contract is concluded with Service and Tourism Marketing Agency TK GmbH.

By placing the products in the online store we make a binding offer to conclude a contract for these articles. You can place our products in the shopping cart without obligation and correct your entries at any time before sending your binding order by using the correction aids provided and explained in the order process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button Booking. Immediately after submitting the order you will receive another confirmation by e-mail.

4. Terms of delivery

Shipping costs are added to the indicated product prices. You can find out more about the amount of the shipping costs in the offers.

In principle, you have the possibility of picking up your order at Tourismus Information, Grünstraße 25, 12555 Berlin, Germany during the following business hours: Mo-Fr 10 – 16 o’clock within two weeks

5. Payment

In unserem Shop stehen Ihnen grundsätzlich die folgenden Zahlungsarten zur Verfügung:

credit card

When you place your order, you provide your credit card details. After your legitimation as a legitimate cardholder, the payment transaction will be carried out automatically and your card will be charged.

PayPal

During the ordering process you will be redirected to the website of the online provider PayPal. In order to pay the invoice amount via PayPal, you must be registered there or first register, legitimize with your access data and confirm the payment instruction to us. After placing the order in the store, we will ask PayPal to initiate the payment transaction. The payment transaction will be executed automatically by PayPal immediately afterwards. You will receive further instructions during the ordering process.

Sofort by klarna

After placing your order you will be redirected to the website of the online provider Sofort GmbH. In order to be able to pay the invoice amount via Sofort, you must have a bank account that is activated for online banking, legitimize yourself accordingly and confirm the payment order to us. You will receive further instructions during the ordering process. The payment transaction will be carried out immediately afterwards by Sofort and your account will be debited.

Giropay

After placing the order you will be redirected to the website of your bank. In order to pay the invoice amount via Giropay, you must have a bank account activated for online banking, you must legitimize yourself accordingly and confirm the payment order to us. You will receive further instructions during the ordering process. The payment transaction will be executed immediately afterwards and your account will be debited.

Amazon Pay

During the order process you will be redirected to the website of the online provider Amazon before the order process in our online store is completed. In order to be able to complete the order process and pay the invoice amount via Amazon, you must be registered there or register first and authenticate yourself with your access data. There you can select the delivery address and payment method stored at Amazon, confirm the use of your data by Amazon and the payment instruction to us. You will then be redirected to our online store where you can complete the order process. Immediately after placing your order, we will ask Amazon to initiate the payment transaction. The payment transaction will be automatically processed by Amazon. You will receive further instructions during the ordering process.

Cash payment at pick up

You pay the invoice amount in cash upon collection.

6. Eigentumsvorbehalt

7. Damage in transit

If goods with obvious transport damages are delivered, please complain about such defects to the deliverer as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, especially your warranty rights. However, you help us to be able to assert our own claims against the carrier or the transport insurance company.

8. Warranty and guarantees

The statutory liability for defects shall apply. Information on any additional warranties and their exact conditions can be found with the product and on special information pages in the online store.

9. Streitbeilegung

The European Commission provides a platform for online dispute resolution (OS), which you can find here. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

 

General Terms and Conditions of theTourismusvereins Berlin Treptow-Köpenick e.V. (TTK)

1. Object of mediation

The Tourismusverein Berlin Treptow-Köpenick e.V. (TTK) mediates tourist services. The TTK does not furnish with its activity own achievements, it mediates these rather in the name and for calculation of other enterprises, the so-called service providers (LT). When arranging individual travel services or a package of travel services, the TTK does not act as a tour operator, but in relation to its customers only as a business agent.

The TTK offers rooms in the name of the LT via its reservation system. The accommodation company (BHB) is obliged to make the reserved rooms available for the booked period. The guest is obliged to pay the agreed room price for the contract period. The guest pays the fee for the room(s) booked by him/her in the booked BHB. Any claims shall be asserted exclusively against the BHB. The BHB shall charge a placement fee for room placement by the TTK. The booked rooms are kept free by the BHB on the day of arrival until 18:00 hours. The customer is obliged to inform the BHB if the arrival is expected to take place after 6:00 p.m. In the case of guaranteed bookings (down payment or advance payment or credit card details), the booked rooms shall be kept free even after 6:00 p.m. until the guest arrives. The same applies to bookings made after 18:00 hrs on the day of arrival.

The Guest may withdraw from the contract at any time before the start of the trip by submitting a declaration of withdrawal to the TTK. The withdrawal shall be declared in writing. If the withdrawal is made at short notice – from two days before arrival – the withdrawal must also be declared directly to the AF by the guest.

Cancellations are generally possible free of charge provided that they are received by the AF in writing at least one day before the booked arrival date at 6:00 p.m. If a booking is cancelled by the guest on the day of arrival, the BHB is entitled to demand compensation from the guest in the amount of the agreed accommodation price less saved expenses. The cancellation fees charged amount to 80% of the room price for the first night. The AF shall be entitled to demand further compensation for damages in the case of a booking over several nights if it can prove that the rooms freed up by the cancellation could not be put at the disposal of another party. The guest is still permitted to provide evidence that no damage or reduction in value has occurred at all or that it is considerably lower than the flat rate. This also applies in case of unannounced no-show.

For group bookings from 8 rooms/ 16 persons, the terms and conditions of the respective BHB apply exclusively.

2. Tickets

In the case of card offers, the customer receives an invoice with the amount to be paid. The reservation becomes effective only after payment has been received in due time. The customer bears the risk for delays in payment by bank or post. If the payment is not received in time, the reservation expires automatically; the customer is no longer entitled to the tickets. After receipt of payment by TTK, the Customer shall receive either a booking confirmation/ voucher or the admission tickets themselves by post.

In the case of booking inquiries for groups, the Customer shall receive an offer indicating the group conditions and the date of payment.

Exchanges and returns are excluded.

3. Tourist guide

The TTK arranges tour guides. The amount for the booked service will be paid by the customer in cash to the tour guide after the service has been provided or to the TTK after the invoice has been issued. Without further agreement, the maximum waiting time of the tour guide for the customer is 30 minutes and will be deducted from the total time of the agreed service. If the intended size of the group is exceeded, a surcharge of 10.00 EUR per tour may be levied.

Cancellation conditions for tour guide services:

– up to 7. working days before service provision free of charge

– from the 6th working day until the 1st working day before the service is provided: 80% of the agreed service

– on the day of performance or in case of non-utilization: 100% of the agreed performance.

The guest is allowed to prove that no damage or reduction in value has occurred at all or that it is considerably lower than the flat rate. The services will be invoiced to the customer accordingly. The cancellation shall become effective on the day on which it is received by the TTK. The burden of proof shall lie with the Customer.

4. Bus and ship charter brokerage

The TTK arranges buses, ships and other means of transport. The general terms and conditions of the respective LT apply.

5. Venues and restaurants

The TTK arranges venues and restaurants on behalf of LT. The terms and conditions of the respective LT apply.

6. Travel Events

The traveler can withdraw up to the beginning of the journey. In this case he is obliged to make payments according to the following scale: from 29 to 22 days before the start of the journey a cancellation fee of 15%, from 21 to 15 days 25%, from 14 to 7 days 50% and from 6 to 1 day before the start of the journey 80% of the price of the journey. In case of non-departure 100% of the price of the trip is to be paid. In case of no-show on the day of departure there will be no refund. If the minimum number of 20 participants is not reached, the TTK can cancel the trip up to 7 days before the planned start of the trip. The traveler will be informed by telephone or in writing.

The guest is allowed to prove that no damage or reduction in value has occurred at all or that it is considerably lower than the flat rate. Warranty claims must be asserted by the Traveller within one month after the contractually agreed end of the trip against the tour operator or TTK. The TTK draws attention to the possibility of taking out travel cancellation insurance or insurance to cover repatriation costs in the event of illness or accident. The TTK is gladly ready to arrange such contracts.

7. Other services

8. Liability

The liability of the TTK is limited to intent and gross negligence. In the context of travel events, the liability of the TTK for damage which is not physical injury is limited to three times the travel price, provided that damage is not caused intentionally or by gross negligence or provided that the tour operator is responsible for damage incurred by the traveller solely due to the fault of a LT. All warranty claims §§651d ff BGB expire 1 year after the day on which the journey should end.

9. General information

The invalidity of individual provisions of the General Terms and Conditions shall not result in the invalidity of the entire General Terms and Conditions.
